Court Applications for Probate

When a person dies and leaves a Will, the executor named in the Will may need to apply to court to validate his or her appointment before he or she can deal with certain assets that form the deceased person’s estate. Such a court application is commonly called a Probate Application or more formally, an Application for a Certificate of Appointment of Estate Trustee with a Will.

Where a person dies without a Will, a family member will usually need to apply to court for a Certificate of Appointment of Estate Trustee Without a Will in order to have authority to deal with the estate.
