It is not prudent for a solicitor to attend unrepresented at an assessment of costs, as the solicitor is testifying under oath and will be cross-examined. We can provide some general advice for narrowing the issues, providing productions and document briefs, preparing for and attending at the assessment, opening submissions, and tips for examinations-in-chief, cross-examinations and closing submissions. In some instances, it may be appropriate to have a litigation colleague from your firm attend as counsel and in other cases, it is appropriate to have our firm attend on your behalf.
