If your lien rights have expired, you cannot seek relief under the extraordinary remedies and powers of Construction Lien Act. However, you can still go to court to enforce your rights under breach of contract. For example, under the Act, a subcontractor can register a lien against the owner’s property, despite having no direct contract with the owner. A subcontractor who sues for breach of contract is limited to suing only those with whom the subcontractor has a direct contract.
