Can a developer retain the Buyer’s deposits pending closing?

No. All deposits that a developer receives from the Buyer towards the purchase of the unit must be held in trust by the developer’s lawyer or a trustee (or guaranteed by a Tarion deposit receipt for residential condominiums) or other prescribed security. A Buyer should receive a form from the developer or its lawyer confirming that the deposit is being held in trust.
