We have successfully obtained court orders in such cases requiring the land registrar to discharge a mortgage that clouds title and where the lender has not demanded payment. As a matter of law, where there is a mortgage on title for 20 or more years and the lender has made no demands for payment, the borrower may apply to the court to have the mortgage discharged.
