Builder’s forms of Agreements of Purchase and Sale are lengthy and drafted strongly in the builder’s favour. There are unilateral rights for the builder to extend the closing date of the deal without the Buyer’s consent and usually additional costs that will be charged to the Buyer as adjustments on closing. These additional costs, such as utility connection costs, development charges and mortgage discharge fees, can amount to many thousands of dollars. HST is charged on new homes and typically included within the purchase price, but expect that any applicable rebate will be assigned back to the builder. If you will not be living in the home yourself, so that the rebate is not applicable, you will be charged the amount of the rebate. It is important to have your real estate lawyer review the form of Agreement before you sign it so that you understand your rights and obligations.
