The Code is considered to be a quasi-constitutional piece of legislation that protects people from discrimination and harassment in the areas of employment, housing, contracts, membership in trade and vocational associations, and goods, services and facilities. Of relevance for employers, the Code prohibits discrimination and harassment on the following enumerated grounds:

- Creed
- Sex, including sexual harassment and pregnancy
- Sexual orientation
- Gender identity
- Gender expression
- Family status
- Marital status
- Age
- Record of offences
