The Problem

Our client, a developer, had been sued by a corporation which claimed that our client had agreed to advance financing. The plaintiff company also alleged that our client had breached an agreement containing an option to purchase.

Our Approach

We defended the action on the grounds that the plaintiff was essentially attempting to re-litigate issues that had already been dealt with by the courts previously.

The Result

We were successful in bringing a summary judgment motion before the court and had the plaintiff’s claim dismissed without a full trial.
